Terms of Service

Welcome to Auxy.

These Terms of Service (“Terms”) govern your access to and use of the Auxy mobile application, website, and related services (collectively, the “Services”).

By creating an account, accessing, or using Auxy, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1. About Auxy

Auxy is a social music platform that allows users to create and join events, manage playlists, submit song requests, interact with music experiences, and connect with others through shared music.

Auxy provides the platform only and does not organize, host, supervise, or control user-created events.

2. Eligibility

You may only use Auxy if doing so is permitted under the laws applicable to you.

By creating an account or using the Services, you represent and warrant that:

  • You are at least 13 years old. In jurisdictions that set a higher age of digital consent (for example, 16 in parts of the European Economic Area), you are at least that age, or you are using Auxy with the consent of a parent or legal guardian.
  • You have the legal capacity to enter into these Terms.
  • Your use of Auxy does not violate any applicable laws or regulations.
  • All information you provide is accurate and current.

If we become aware that a user is not legally permitted to use the Services, we may suspend or terminate the account without notice.

3. User Accounts

To use certain features of Auxy, you must create an account.

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate information.

You agree not to:

  • Share your account with others.
  • Create accounts using false information.
  • Impersonate another person or organization.

4. Public and Private Events

Auxy allows users to create public and private events.

Public Events

Public events may be visible to other Auxy users and may include:

  • Event name
  • Event image
  • Event details
  • Event playlist
  • Event location (if enabled by the organizer)

Private Events

Private events are intended for invited participants.

Event organizers control who may access their events and what information is displayed.

Auxy cannot guarantee that information shared within private events will remain confidential if attendees choose to share it elsewhere.

5. User Content

Users may create, upload, submit, or share content through Auxy, including:

  • Event photos
  • Event details
  • Playlist information
  • Song requests
  • Reactions and interactions

You retain ownership of any content you submit.

You are solely responsible for the content you submit.

6. Prohibited Conduct

You agree not to:

  • Violate any applicable law.
  • Harass, threaten, or intimidate others.
  • Post defamatory, hateful, discriminatory, or abusive content.
  • Upload pornographic or sexually explicit content.
  • Impersonate another person.
  • Distribute spam or malicious content.
  • Attempt to gain unauthorized access to Auxy systems.
  • Interfere with the operation of the Services.
  • Use Auxy for illegal activities.

Auxy reserves the right to remove content or restrict access for violations of these Terms.

7. User-Generated Content Moderation

Auxy enables user-generated content. We take a layered approach to keep the community safe:

  • Content filtering. Auxy uses automated filtering on submitted content (such as event names, song requests, and chat) to detect prohibited material.
  • Reporting. Every user profile, event, and message in Auxy includes a Report option. Reports are reviewed by our moderation team.
  • Blocking. You can block any user at any time. Blocked users cannot contact you, send invites, or interact with your content.
  • 24-hour action commitment. Auxy will review reports of objectionable content or abusive behavior and act on them within 24 hours, including by removing content and ejecting the offending user where appropriate.
  • Contact. To report objectionable content outside the app, email vibes@auxydj.com with the report details.

8. Music and Third-Party Services

Auxy may integrate with third-party services, including music and video platforms.

Content accessed through third-party services remains subject to the terms, policies, and licensing agreements of those providers.

Auxy does not claim ownership of music, videos, or other content provided by third-party platforms.

Users are responsible for complying with the terms of any third-party services used through Auxy.

Auxy and its associated trademarks, branding, logos, software, designs, and content are owned by Auxy or its licensors and are protected by applicable intellectual property laws.

You may not:

  • Copy
  • Modify
  • Reverse engineer
  • Distribute
  • Sell
  • Exploit

any part of the Services without our prior written permission.

Copyright takedown

If you believe content available through Auxy infringes your copyright, please send a written notice to vibes@auxydj.com including:

  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the material that is claimed to be infringing, with enough detail for us to locate it (such as the event ID, profile URL, or screenshot).
  • Your contact information (name, address, telephone, email).
  • A statement, made in good faith, that you believe the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.
  • Your physical or electronic signature.

Auxy may remove allegedly infringing content and may terminate the accounts of users who are repeat infringers.

10. User Safety and Events

Auxy provides a platform that enables users to create, discover, and participate in music-related events and experiences.

Auxy is not an event organizer, promoter, venue operator, or participant in any user-created event.

Users are solely responsible for:

  • The events they create.
  • The information they share.
  • Their interactions with other users.
  • Compliance with applicable laws and regulations.

Participation in any event, whether public or private, is at your own risk.

Auxy is not responsible for the conduct of users, organizers, attendees, venues, or third parties, whether online or offline.

11. Suspension, Termination, and Account Deletion

Auxy may suspend, restrict, or terminate your account at any time if:

  • You violate these Terms.
  • We believe your activity presents a risk to other users.
  • We are required to do so by law.

We may also remove content that violates these Terms or our policies.

You may delete your account at any time from within the app by opening Profile and tapping Delete Account, or by emailing vibes@auxydj.com from the email address associated with your account. The account is deactivated immediately and permanently deleted after a 14-day grace period during which you can cancel the request. Account-deletion details are described in our Privacy Policy.

12. Disclaimers

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Auxy makes no warranties regarding:

  • Availability of the Services
  • Accuracy of content
  • Reliability of third-party services
  • Uninterrupted access to the platform

We do not guarantee that the Services will be error-free or continuously available.

13. Limitation of Liability

To the fullest extent permitted by law, Auxy, its affiliates, directors, employees, and partners shall not be liable for:

  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Loss of profits
  • Loss of data
  • Personal injury
  • Damages arising from user interactions or attendance at events

Your use of Auxy is at your own risk.

14. Indemnification

You agree to defend, indemnify, and hold harmless Auxy and its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your content
  • Your violation of these Terms
  • Your interactions with other users

15. Apple App Store Terms

If you obtained Auxy from the Apple App Store, the following additional terms apply, and they take precedence over any conflicting provisions of these Terms in respect of your App Store use of Auxy:

  • These Terms are an agreement between you and Auxy only, not with Apple Inc. (“Apple”). Apple is not responsible for Auxy or its content.
  • Auxy is licensed to you on a limited, non-transferable, non-exclusive basis to use on Apple-branded devices that you own or control, in accordance with the App Store Usage Rules set out in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide any maintenance or support services for Auxy.
  • In the event of any failure of Auxy to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Auxy to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Auxy.
  • Auxy, not Apple, is responsible for addressing any claims by you or any third party relating to Auxy, including product-liability claims, claims that Auxy fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
  • Auxy, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to Auxy.
  • You represent and warrant that you are not located in a country subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country, and you are not on any U.S. government list of prohibited or restricted parties.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Changes to the Services

We may modify, suspend, or discontinue any feature of Auxy at any time without prior notice.

We may also update these Terms from time to time.

Continued use of Auxy after changes become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles.
